Agreement

These Terms of Service ("Terms") govern your access to and use of Pulse OS Health ("Pulse OS," "we," "us") websites, client portal, and related services at pulseoshealth.com. By creating an account or using the service, you agree to these Terms and our Privacy Notice.

If you do not agree, do not use Pulse OS.

The service

Pulse OS is a wellness and care-coordination platform that aggregates wearable, laboratory, and clinical information for clients and authorized clinicians. Pulse OS is not a medical device and does not provide medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional for medical decisions. Do not delay or disregard professional advice because of information in the platform.

Accounts and eligibility

You must be at least 18 years old to use Pulse OS. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

You agree to provide accurate information during onboarding and to keep your profile current. We may suspend or terminate accounts that violate these Terms or pose a security risk.

Acceptable use

You may use Pulse OS only for lawful personal or authorized clinical purposes. You may not misuse the service, attempt unauthorized access, reverse engineer the platform, scrape data, or interfere with other users.

You may not upload content you do not have rights to share, or use the service to transmit malware or harmful code.

Health data and device connections

When you connect wearables or upload labs, you authorize Pulse OS to ingest and process that data to provide dashboards, baselines, and care-team visibility you configure.

Third-party device providers (for example WHOOP, Apple Health, Oura) have their own terms and privacy policies. Disconnect devices at any time in the portal.

Care team and sharing

If you invite or authorize clinicians or care-team members, you direct us to share relevant profile and health data with those individuals. You can manage sharing preferences in onboarding and account settings.

Clinicians using Pulse OS are responsible for their own professional obligations, including consent, record-keeping, and scope of practice.

Fees and beta features

Some features may be offered during beta or under clinic programs with separate pricing. We will communicate applicable fees before charging you.

We may modify, suspend, or discontinue features with reasonable notice when practicable.

Intellectual property

Pulse OS, including software, branding, and content we provide, is owned by Pulse OS Health or its licensors. We grant you a limited, non-exclusive license to use the service for its intended purpose while your account is active.

You retain ownership of content you submit. You grant us a license to host, process, and display that content solely to operate and improve the service.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free operation, or that insights generated by the platform will be accurate or complete.

Limitation of liability

To the maximum extent permitted by law, Pulse OS Health and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the service.

Our total liability for any claim relating to the service will not exceed the greater of (a) amounts you paid us in the twelve months before the claim, or (b) one hundred Canadian dollars (CAD $100), except where liability cannot be limited by applicable law.

Indemnity

You agree to indemnify and hold harmless Pulse OS Health from claims arising out of your misuse of the service, violation of these Terms, or infringement of third-party rights, except to the extent caused by our gross negligence or willful misconduct.

Termination

You may stop using Pulse OS at any time. We may suspend or terminate access if you breach these Terms or if required for legal or security reasons.

Sections that by nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.

Governing law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Courts in Ontario shall have exclusive jurisdiction, except where consumer protection laws in your jurisdiction require otherwise.

Changes

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms.
